After the glorious Islamic Revolution of the Iranian people in 1979, the urgent need for the new political system to design governance structures and frameworks based on fundamental principles and values, such as the realization of the rulings and teachings of Islam in the social system, justice, independence, freedom, etc. led to the intelligent planning of Imam Khomeini (RA), a group of elected representatives of the nation, the overwhelming majority of whom were jurists, drafting and approving the text of the Constitution of the Islamic Republic of Iran within a limited period of several months; a text that, after being approved by the Supreme Leader of the Islamic Revolution, was approved by the majority of the Iranian people in a referendum.
Since the Constitution of the Islamic Republic of Iran sought to design new legal systems based on the standards of Islamic law and, as its preamble acknowledges, sought to explain the cultural, social, political, and economic institutions of Iranian society based on Islamic principles and regulations, on the one hand, like other constitutions, it has stated a set of governmental structures in the new political system, the limits of authority of officials, and public rights and freedoms and the method of guaranteeing them. On the other hand, it expresses the foundations, goals, duties, values, and superior norms of the political system with a view to religious teachings. This is considered the distinguishing feature of the Constitution of the Islamic Republic of Iran from modern Western constitutions, which are the result of the religious movement.
Therefore, legal study and analysis of various aspects of the Constitution, including its bright and progressive points, structures and institutions of government and the limits of their authority, neglected capacities of the Constitution, comparative study of the Constitution, and possible ambiguities and deficiencies in it, and such matters are considered necessary and essential.
